Terms of Service

These terms govern your use of CastGhost (the "Service"). By using the Service you agree to them. If you are using the Service on behalf of a company, you agree on its behalf.
1. The Service
CastGhost is a managed podcast-outreach service. We set up and run a private instance for you that researches podcasts matching your expertise, drafts pitches using your bio and talking points, and sends the pitches you approve from your connected Gmail account. We host and maintain the software and supporting accounts; you do not need to create any third-party accounts other than connecting your own Gmail.
2. Your responsibilities
- You approve every email. Nothing is sent without your action. You are responsible for reviewing each pitch and for the content of every email sent from your account.
- Accurate information. Your bio, credentials, and claims must be truthful. Pitches are drafted from what you provide.
- Lawful outreach. You must comply with the email and privacy laws that apply to you and your recipients. These may include CAN-SPAM (US), CASL (Canada), and GDPR/PECR (UK/EU). This includes honouring any request from a recipient to stop contacting them.
- Gmail rules. You must comply with Google's terms and sending limits for your Gmail account. We are not responsible for actions Google takes against an account that breaks its rules.
3. Acceptable use
You may not use the Service to:
- send bulk, unsolicited, or automated mass email, or email unrelated to guest appearances
- harass, deceive, or impersonate anyone
- send unlawful, defamatory, or infringing content
- scrape, resell, or redistribute the podcast research data outside your own outreach
- attempt to access other clients' data or interfere with the Service
We may suspend the Service if we reasonably believe these terms are being broken.
4. AI-generated content
The Service uses artificial intelligence to assess podcasts and draft pitches. AI output can be inaccurate, incomplete, or unsuitable. Podcast assessments, host names, and contact details are best-effort research and may be out of date or wrong. Review everything before you rely on it or send it.
5. No guarantee of results
We do not guarantee that any pitch will be answered or that you will be booked on any podcast.
6. Fees and billing
Fees, included usage, and any charges for usage above the included amount are set out in your order or agreement with BottBott Business Systems. Fees are billed monthly in advance and are non-refundable except where required by law. We will give at least 30 days' notice of any change to your fees.
7. Ownership
- Your content. You own your bio, talking points, notes, and the pitches sent from your account. You give us permission to use them only to provide the Service to you.
- Our software. The Service, including its software, prompts, scoring methods, and research data compiled by the Service, belongs to BottBott Business Systems. These terms do not transfer any ownership of it to you. Ownership of a dedicated instance is available only under a separate written agreement.
8. Third-party services
The Service relies on third-party services, including Google (Gmail API and YouTube API Services), Anthropic, Supabase, Cloudflare, and podcast directories. By using the Service you agree to be bound by the YouTube Terms of Service. We are not responsible for outages or changes in third-party services, but we will make reasonable efforts to keep the Service working.
9. Privacy
Our Privacy Policy explains how we handle your information, including Google user data.
10. Ending the Service
You may end the Service at any time by giving 30 days' notice, subject to your agreement. We may end it with 30 days' notice, or immediately for a serious breach of these terms. On request we will provide an export of your data. We will then delete your instance as described in the Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, BottBott Business Systems is not liable for any indirect, incidental, special, or consequential damages. This includes lost bookings, lost profits, and damage to reputation or to an email account. Our total liability for any claim is limited to the fees you paid in the three months before the claim arose.
13. Changes to these terms
We may update these terms. We will notify you by email before material changes take effect. Continuing to use the Service after that means you accept the updated terms.
14. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be resolved in the courts of Ontario.
